Is the Email Archiving system not compliant with Security Laws in Germany (EU)?

Hello Sugar community,

since we are located in Munich, (Germany) we
  see a problem arising from German data protection laws. §9
Bundesdatenschutzgesetz restricts the right of companies to transmit
non-public, personal data. Why could it be justified to send such data
to a CRM server abroad?

Sending it to the US opens another can of worms: §4b data protection law
  restricts even a justified transfer if a sufficient data protection
cannot be shown at the destination. How can this level be justified in
the case of the Sugar server in the US?
