Email Opt-In to comply with new Canada Spam Law

In Canada you must now receive permission (OPT-IN) before sending an email to leads ( SugarCRM only has an OPT-OUT checkbox associated to an email address.

There's already a feature request for this:

We will have to customize our Sugarondemand v6.7.6 to tackle this problem but I was wondering what would be the best way to go about it?

We could add an OPT-IN attribute to each email address. Could we tell Sugar, when someone subscribes to our newsletter, to always check the OPT-IN and always uncheck OPT-OUT even if it's already unchecked? Would that work?

If someone has subscribed then unsubscribed, the OPT-OUT would be checked. So if the person subscribes again, we need to check OPT-IN and uncheck OPT-OUT absolutely.

Maybe there's a better way to do this?
Would the code be upgrade proof?
